Focus Magazine Terms & Conditions
The placing of an order with Over Wyre Focus magazine or Garstang Focus magazine (hereinafter referred to as "Focus") whether in writing, by telephone or by email, will be deemed to be an acceptance of these Terms & Conditions by the Advertiser:
All adverts are accepted by Focus on the understanding that they are copyright free. This includes any images, logos, photos, trade logos, clipart or any other content that is used in the advert. It is the Advertiser's responsibility to acquire any necessary permissions for the use of any images, logos, photos, trade logos, clipart or any other content that is used in their advert.
Where an advert submitted to Focus has been used or has been created for use in any other publication, promotion or promotional material, it is the Advertiser’s responsibility to acquire any necessary permissions for the use of any images, logos, photos, trade logos, clipart or any other content that is used in their advert.
Focus reserves the right to refuse/edit advertisements or articles at its discretion. It reserves the right not to accept advertisements or articles which may be considered defamatory or offensive or which promote products that may be considered indecent.
Focus reserves the right not to accept advertisements or articles which may be considered unsuitable or incompatible with the magazine.
Adverts are accepted on the understanding that descriptions of goods and services are fair and accurate. Focus cannot and does not accept any responsibility for views expressed by contributors, or for the accuracy of claims made by advertisers.
Copy for advertisements must be sent to Focus before the booking/copy deadline date (usually the third Monday of the month preceding month of issue, unless advised otherwise).
Advertisements submitted should be preferably in one of the following formats: PSD, JPEG, PDF, TIFF, MS Publisher or MS Word. Copy can be e-mailed to helen@focusmags.co.uk or delivered by hand or posted to Focus Magazines, 132 Highfield Rd, Blackpool FY4 5LH.
Any logos, images or photographs supplied should be at a minimum of 300dpi. No responsibility can be taken for the print quality of any logos, images or photographs supplied at a lower resolution.
Logos, images or photographs supplied in RGB will be converted to CMYK prior to printing. Focus does not accept any responsibility for any changes to colour, density or appearance experienced following this conversion process.
Any adverts supplied in JPEG, PDF or any other pre-prepared format will be inserted into the magazines as supplied and will be assumed not to require copy approval. These files should be supplied at a minimum of 300dpi and correctly sized for the space booked. No responsibility will be taken for the print quality of any advert supplied at a lower resolution. Incorrectly sized files may be re-sized to fit the appropriate space.
If an advertiser requests that their advert is to be designed by Focus, it is the advertiser’s responsibility to ensure that the correct information for inclusion within the advert is made available to Focus by the advised booking/copy deadline date. Whilst every care will be taken to ensure accuracy, Focus cannot accept responsibility for loss, damage or omission caused by error in the creation or printing of an advert or other information. It is the Advertiser's responsibility to request copy approval prior to copy deadline date if they wish to check the advert before it goes to print. No responsibility will be taken by Focus for any errors subsequently identified (i.e. after copy approval).
Focus is not and does not purport to be a graphics design house; Focus is a Publisher. Any artwork or design created by Focus is offered on a ‘best efforts’ basis and does not form any part of the change for advertising space. However, if due to the perceived complexity of an advert or design, extra time has to be spent in the creation of an advert, then the Advertiser will be advised that an artwork/design creation charge is payable in addition to the cost of the advertising space. Such an advert or design will be offered to the Advertiser for proofing and acceptance in advance of publication.
Fonts used or intended for use within an advert should be embedded or additionally supplied to Focus as .ttf files. It is the Advertiser’s responsibility to advise Focus of preferred fonts and/or styles and which fonts are attributable to which lines or blocks of text. Focus reserves the right to substitute fonts at its discretion where the fonts or attribute information have not been supplied.
The booking of an advert space with Focus is not a guarantee of page position or position on a page within any publication.
Any advert/editorial/article/design which Focus has created may not be used in another publication or advertising medium (e.g. website) without the prior written approval of Focus. A fee may be payable to Focus if an advertiser wishes to re-use an advert/editorial/article/design in this way.
All invoices are payable within 14 days of the date stated on the invoice for advertisers with credit accounts or by the booking/copy deadline date, whichever is sooner for new advertisers until an agreed credit account is opened. In no circumstances shall the advertiser be entitled to make any deduction or withhold payment for any reason at all.
Any adverts for which space has been booked but payment has not been received by the date stipulated will not be published but the pre or subsequent invoiced amount will be due in full.
Where an advertiser requests an advertising space in one or more issues of the magazine Focus will confirm space availability by confirmation telephone call, e-mail or letter. If any such booked advertising is subsequently cancelled before the booking/copy deadline date, a 50% cancellation fee will apply.
Once an agreement to advertise in any subsequent issue has been given by any one of the above methods, if the copy does not arrive in time for publication, the full cost of the advertisement will still be due as the space for that advert will have been reserved specifically in the layout of the magazine for that advertiser.
If an advertiser books a series of adverts or gives Focus a “run until further notice” instruction but wishes to change their advert in the second or subsequent months, it is their responsibility to ensure that any new advert or change in information reaches Focus before the relevant booking/copy deadline date. Otherwise, the previous advert will be re-inserted and no refund will be offered or given.
Without prejudice to any other rights of Focus, if the advertiser fails to pay the invoice by the due date the advertiser shall not be allowed any discount given in that invoice or in any other way agreed and shall pay interest on any overdue amount from the date of which payment was due to the date of actual payment (whether before or after judgment) on a daily basis at a rate of 4% p.a. over the base rate from time to time quoted by National Westminster Bank plc and shall reimburse to Focus all costs and expenses (including legal costs) incurred in the collection of any overdue amount.
Advertisers who pay for their advert by standing order are advised that their advert will be printed in the magazine until such time as they notify Focus that they wish to cancel. Standing orders must be set up so that payment is received by Focus by the booking deadline date for the month of issue, i.e. prior to printing, unless extended credit terms have been agreed for payment with the Advertiser.
It is the Advertiser's responsibility to inform Focus if they wish to stop running their advert and such notification must be received by the booking deadline date prior to printing. If the advertiser cancels their standing order without informing Focus and the advert is subsequently published as a result, the advertiser will be invoiced separately for the advertising cost thereof. The advert will only be deemed to be cancelled when Focus advises the Advertiser that it is in receipt of the cancellation request.
Similarly, if a standing order has been set up for a specific number of issues and is then cancelled earlier than expected, a separate invoice will be issued for any discounts already given in respect of the expected longer run of advertising
Focus gives no guarantee of the level of response to adverts/editorial/articles etc. Focus will not offer any refund if no responses are received.
The distribution area of the magazines and the quantity published and delivered may vary at the discretion of Focus.
